Un Plan de Igualdad es obligatorio cuando:
La plantilla sea superior a 50 personas
Lo establezca el convenio colectivo de aplicación
La Autoridad Laboral lo hubiera acordado en un procedimiento sancionador, donde se especifique la sustitución de las sanciones accesorias por la elaboración de un plan de igualdad
Para el resto de empresas la elaboración de un Plan de Igualdad tendrá carácter voluntario. Desde la Administración Pública se ofrecen subvenciones para la elaboración de Planes de Igualdad de carácter voluntario.
